Overdue books fees

Rules of cancellation, deferment, and payment in installments of financial liabilities for overdue library collections

Legal basis:

  1. Act of 27 June 1997 on libraries (consolidated text: Journal of Laws of 2019, art. 14, item 2);
  2. The Act of 27 August 2009 on public finance (consolidated text: Journal of Laws of 2017, item 2077 );
  3. Regulations for providing access to collections and using the services of the Main Library of  AGH University of Science and Technology in Krakow.

§1

  1. Financial receivables for library collection overdue charges may be waived in whole or in part in the case of
    1. users demise,
    2. extraordinary circumstances at the individual request of a user,
    3. when there is a justified suspicion that the costs of enforcement proceedings will not exceed the costs of claiming and recovering the debt or the enforcement proceedings have been unsuccessful,
    4. occurrence of causes attributable to the Library (e.g., system failure).
  2. The remission of payment or its part for keeping library materials, postponing the payment date, spreading the payment in installments is made on the basis of the user's application form filled in according to attachment no. 1.
  3. The request may be accompanied by documents or copies of them justifying, in the opinion of the debtor, the request. Applications are considered on a case-by-case basis and cancellation of the fee or part thereof depends on the circumstances stated in the application.
  4. The Requests are considered on a case-by-case basis and remission of payment or part of it depends on the circumstances stated in the request.
  5. In cases justified by social reasons, at the request of a user, the date of payment of all or part of the amount due can be postponed, the payment can be divided into installments, taking into account the financial capabilities of the user.

§2

  1. Decisions on remission of the fee or its part/deferring the due date or spreading the payment in installments are made by the Director of the AGH University Main Library, his deputies, or the head of the Circulation Department.
  2. A precondition for making a decision about remission of a debt or its part, deferment of the payment deadline, or payment in installments is the return of the library materials kept or providing substitute documents indicated by the head of the Circulation Department.

§3

  1. The administrator of the personal data is  AGH University, A. Mickiewicza Ave. 30, 30-059 Kraków.
  2. Personal data shall only be processed for the purposes specified in Article 49, item. 2 of the Act of 20 July 2018. - Law on Higher Education and Science and § 38 item 5 of the AGH Statutes of 26 June 2019 and are used exclusively to perform tasks of the AGH library and information system.
